1. Introduction Welcome to CabFare! By accessing or using the CabFare Tap-to-Pay app (the "App"), CabFare Payment Terminal (the “Terminal”), our website, or Customer Portals, you agree to be bound by these Terms of Use ("Terms"). If you do not agree with these Terms, please do not use our services.
2. Compliance & Regulations Commercial passenger vehicle drivers, fleet operators, and booking service providers (the “Customer”) must take reasonable steps to prevent fraudulent payments and report any security breaches to CabFare immediately.
3. CabFare Services
The CabFare App provides a software application that enables Customers to accept contactless payments directly through their smartphones, eliminating the need for additional hardware.
The CabFare Terminal provides a hardware device that enables Customers to accept card present payments.
The CabFare Website and Customer Portals facilitate account management, payment review, and customer support.
CabFare acts solely as a payment facilitation platform, enabling secure payments between Customers and cardholders. CabFare does not provide transportation services; all transportation services are provided by Customers.
4. Customer Accounts
Registration: Customers must create an account by providing accurate and complete information. Customers are responsible for maintaining the confidentiality of their account credentials and for all activities occurring under their account.
Eligibility: Customers must be at least 18 years old. By creating an account, Customers represent and warrant that they meet this age requirement.
5. Customer Conduct Customers agree to use CabFare services in compliance with all applicable laws and regulations and must not:
Use CabFare services for unlawful purposes.
Cause nuisance, annoyance, or inconvenience to others or third parties.
Impersonate any person or entity or misrepresent their affiliation with another entity.
6. Payment Terms
Charges: Cardholders agree to pay all charges associated with payments processed through the CabFare services, including applicable service fees.
Refunds: Payments are generally non-refundable unless required by law or determined otherwise by CabFare.
Payment Authorisation: By using CabFare, cardholders authorise payments to be processed and acknowledge responsibility for ensuring sufficient funds are available.
7. Customer Payouts
CabFare will settle funds to the Customer’s nominated bank account after deducting applicable fees and chargebacks.
Funds may be held for regulatory, fraud prevention, or chargeback-related reasons.
Customers must maintain accurate payment records for audit and dispute resolution.
8. Security & Fraud Prevention
Customers must process payments accurately and lawfully.
Customers must not require cardholders to waive chargeback rights.
Fraudulent or prohibited payments (e.g., multiple payments to evade authorisation limits, self-payment) are strictly prohibited.
CabFare reserves the right to suspend or terminate services if a Customer engages in prohibited activities.
9. Disclaimers and Limitation of Liability
Service Provision: CabFare services are provided "as is" and "as available." CabFare disclaims all warranties, express or implied.
Equipment & Hardware Liability: The CabFare Terminal remains CabFare’s property. Customers are liable for replacement costs if lost, stolen, or returned in unsatisfactory condition.
Limitation of Liability: CabFare is not liable for indirect, incidental, special, or consequential damages.
10. Termination CabFare may suspend or terminate services if a Customer:
Violates Scheme Rules, laws, or these Terms.
Engages in high-risk payments or fraud.
Incurs excessive chargebacks.
Causes financial or reputational harm to CabFare.
11. Dispute Resolution
Customers must notify CabFare of any disputes related to payments or chargebacks.
Disputes should first be addressed through CabFare Customer Support.
If unresolved, disputes will be escalated to CabFare’s Compliance Team for review.
12. Liability & Indemnification
Customers are liable for any disputed payments processed through CabFare.
If CabFare incurs a fine, penalty, or loss due to Customer actions, the Customer must reimburse CabFare.
Customers failing to maintain proper security will be held responsible for any fraudulent payments resulting from their negligence.
13. Chargeback Resolution
If a chargeback is filed, CabFare will notify the Customer to provide supporting payment details within seven (7) business days.
If the chargeback is upheld by the card network, the Customer is liable for the disputed amount and applicable processing fees.
Excessive chargebacks may result in security measures, a reserve balance requirement, or suspension of services.
14. Privacy CabFare’s collection and use of personal information are outlined in our Privacy Policy. By using CabFare services, Customers consent to these terms.
15. Modifications to Terms CabFare reserves the right to modify these Terms at any time. Material changes will be posted on our website. Continued use of CabFare services after such changes constitutes acceptance of the updated Terms.
16. Governing Law These Terms are governed by the laws of Victoria, Australia, and any disputes shall be resolved exclusively in its courts.
